Post Judgment Collection
We represent litigants who have obtained a judgment and have been unable to collect their judgment. Parties that have a judgment from another state can use the enforcement of foreign judgment act to domesticate their judgment as a Georgia Judgment. Using post judgment collection tools such as garnishments, document requests, deposition and levy, we locate assets to satisfy the judgment.
Business Purchase and Sale
Individuals interested in buying or selling an existing business need solid representation to ensure that the transaction is properly negotiated and completed in the manner agreed to by the parties. We have the skills to assist in the negotiation, review the sales agreement and related documents and make recommendations that will result in a successful transaction.
Fraudulent Transfers
To avoid a judgment, individuals and businesses may transfer assets to other individuals and businesses without receiving value. Using knowledge and experience gained pursuing fraudulent transfer, we successfully have obtained preliminary injunctions, monetary judgments and court ordered unwinding of improper transfers.
Partnership Disputes
We represent individuals who have an interest in a business with partners or limited investors, but have a dispute that might cause the business to fail. We attempt to resolve these disputes by negotiating an agreement that allows the parties to work towards a mutual resolution. If our efforts are unable to resolve the dispute, we demand that the rights provided by contract and law be enforced.
Landlord/Tenant
We represent commercial property managers and owners in lease drafting, disputes with tenants and the process of eviction. We obtain a writ of possession and manage the eviction process. Then we use post judgment collection tools to obtain a recovery for the loss of rent from the tenant and the tenant’s guarantor.
